Terms of Service

These Terms of Service (the "Terms") govern access to tinyyumzies.ch (the "Site") and the purchase of freeze-dried fruit snacks and related products (the "Products") from Tiny Yumzies ("Tiny Yumzies", "we", "us", "our").

By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or buy from us.

The contract language is English. The Site is also available in German, French, Italian, and Spanish for convenience. If a translation differs, the English Terms control, except where mandatory consumer law in your country of residence requires otherwise.

1. Who we are and what these Terms cover

We sell freeze-dried fruit snacks online. The Site has no customer accounts. You may browse without registering. Checkout is completed on Stripe's hosted payment page.

These Terms apply to consumer and business customers. Nothing in these Terms limits rights you have that cannot be waived under applicable law, including Swiss statutory warranty rights and, where they apply, EU/EEA consumer rights.

2. Eligibility

You must be at least 18 years old and have legal capacity to contract. If you order for a business, you confirm you are authorised to bind that business.

Products are food. They are not medicine. Packaging may include a non-edible oxygen absorber. Keep oxygen absorbers away from children and pets. Always read the label on the bag you receive; the label prevails over website copy if they differ.

3. Products, prices, and availability

Product descriptions, images, ingredients, allergens, sizes, and prices are presented in good faith. Natural produce varies in colour and shape. Images are illustrative.

You are responsible for checking ingredients and allergen information against your needs. Some Products may be processed in facilities that also handle allergens, including gluten. We are not liable for allergic reactions where the information on the label or Site, used with ordinary care, would have allowed you to avoid the Product.

All prices are in Swiss francs (CHF) and include Swiss VAT where applicable. Delivery charges are shown before you pay: CHF 7.00 for orders of CHF 30.00 or less, CHF 12.00 for orders over CHF 30.00 and under CHF 70.00, and free delivery for orders of CHF 70.00 or more, for delivery in Switzerland only. Promotional codes, if offered (including first-order newsletter codes), are subject to the conditions stated with the offer, are not cash, are not transferable unless we say so, and may be withdrawn or changed for future orders.

We may correct obvious pricing or description errors. If we cannot fulfil an accepted order (for example, if stock is insufficient), we will refund the amount you paid for the unavailable items using the original payment method.

4. How a contract is formed

Adding items to the cart is not an offer. When you click through to checkout, you are sent to Stripe to enter delivery and payment details. Your order is an offer to buy the Products at the stated price.

A binding contract is formed when payment is successfully completed and we confirm the order (including by email or by showing a payment-success page linked to that checkout session). We may refuse or cancel an order, including where the shipping country is not supported, payment fails, the order appears fraudulent, or the Products cannot be supplied. If we have taken payment, we will refund it.

Payment methods currently offered at checkout are card and TWINT, processed by Stripe. We do not store full card numbers. By paying, you also deal with Stripe under Stripe's own terms.

5. Use of the Site

You may use the Site for lawful personal or internal business purposes. You must not misuse the Site, attempt to disrupt it, scrape it in a way that overloads our systems, place orders with false details, or use the Site to commit fraud.

All text, images, logos, layout, and other content on the Site are owned by us or our licensors. You may not copy, sell, or commercially reuse that content without our prior written permission, except for ordinary browsing and for printing a copy of these Terms, the Privacy Policy, or the Cookie Policy for your own records.

The Site may be unavailable from time to time. We do not warrant uninterrupted access.

6. Delivery

We currently deliver only to addresses in Switzerland. Checkout will not accept any other country. If other pages on the Site are out of date, this section and the checkout country list control.

We typically process orders within 1 to 2 business days (weekend orders from the next Monday). Delivery is often 3 to 5 business days after dispatch. These are estimates, not guarantees. We do not currently provide package tracking.

We ship through postal and logistics partners. Risk of loss and damage passes to you when the Products are delivered to the address you gave (or when they are made available for collection, if the carrier requires collection and you fail to collect them in time). If you give a wrong or incomplete address, extra delivery costs and non-delivery are your responsibility.

If a parcel arrives damaged, keep the packaging and contact us promptly through the contact form, with photographs. Do not discard evidence until we have had a reasonable chance to assess the claim.

7. Cancellation, returns, and defects

Swiss law does not give a general cooling-off right for online purchases of goods. We do not offer a change-of-mind return for food Products. Unopened and opened bags are not returnable for taste preference, surplus stock, or similar reasons.

Your statutory rights for defective goods under the Swiss Code of Obligations remain. If a Product is defective, including if it arrives damaged or does not match what was sold, contact us through the contact form. We may ask for photographs and the order details. Remedies are those the law allows (repair, replacement, price reduction, or refund, as applicable). We will not treat a CHF amount cap as a substitute for those rights.

Tell us as soon as you reasonably can. For transit damage, contact us within 7 days of delivery where possible, with photographs of the parcel and the Product. Approval of goodwill gestures beyond your legal rights is at our discretion. Where we refund, we use the original payment method. Timing depends on the payment provider; we aim to instruct the refund promptly after we accept the claim.

8. Liability

We are fully liable for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that Swiss law or, where applicable, mandatory consumer law does not allow us to exclude or limit.

Subject to that, we are not liable for: (a) your failure to follow storage or labelling instructions, including eating an oxygen absorber; (b) delay or failure caused by events outside our reasonable control, including carrier disruption, weather, or public authority measures; (c) loss of profit, loss of data, or other indirect or consequential loss, except where mandatory law says otherwise; or (d) website downtime or errors in browsing the Site where no contract of sale is affected.

Where our liability may lawfully be limited, it is limited to the amount you paid for the order giving rise to the claim.

9. Personal data and cookies

How we handle personal data is described in our Privacy Policy. Cookies and similar technologies are described in our Cookie Policy.

10. Newsletter and contact form

If you subscribe to our mailing list, you ask us to store your email and send you marketing, which may include a promotional code. You can ask us to stop at any time through the contact form. The contact form is for genuine enquiries. We may store the message in order to reply.

11. Changes

We may change these Terms for future visits and future orders. The version in force when you place an order applies to that order. We will update the date at the top of this page. Continued browsing after a change means you accept the new Terms for use of the Site. It does not change a contract already formed.

12. Governing law and courts

These Terms and any dispute arising out of them or from an order are governed by Swiss substantive law, excluding its conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Subject to the next paragraph, the courts of the Canton of Zug, Switzerland, have jurisdiction.

If you are a consumer resident in the EU, EEA, or the United Kingdom, mandatory consumer protection rules of your country of residence may also apply. You may bring proceedings in the courts of your country of residence, and we may bring proceedings against you only in those courts, to the extent the applicable jurisdiction rules require that.

13. Other

If a provision of these Terms is invalid, the rest remains in force. We may transfer our rights and obligations to a successor of the business. You may not assign the contract without our consent. A failure to enforce a right is not a waiver. These Terms, the order, and the policies linked from them are the entire agreement for Site use and Product sales, and replace prior statements on the same subject, except for fraud.

Wholesale or other non-retail supply is not offered through checkout. Those arrangements, if any, require a separate written agreement.
